The U.S. Constitution doesn't (IT'S NOT SUPPOSED TO) change, because Presidents change!!! The USA, is a Constitutional Republic. Doesn't talk about PCCs, that is pistol caliber firearm, and not rifle caliber ammunition firearms; there is a difference between SBR having a full stock or a telescoping stock, but then there are the pistol grip shotguns…
I recall that the BATF has a confusing language about shouldering a brace under certain circumstances that would be legal to do so, but never really explained in detail what the legal aspect is.
That interview was disingenuous just like your response video is. He blatantly lied and everyone's acting like he just didn't. CRS firearms is an absolute perfect example of what I'm talking about. Saying they're not alligating resources to go after honest gun owners. They literally federally prosecuted a man for a fucking business card. A laser engraved business card with a depiction of a lightning length that was out of spec intentionally so. If you were to cut it out it would not function or even fit in a lower. And the ATF not only couldn't make it work, they had to use a completely different piece of metal shrink the size to scale of the business card to cut out a lightning link and make one function just to convict him. That is so many steps so far removed from that business card that it would be akin to blaming Glock for a Glock switch. The ATF absolutely will come after you for the most trivial bullshit if they think it will help their favorite political puppet in the polls. Don't ever think that it won't.

Cekadas has clarified this issue by throwing out multiple ATF rules, letters, flawed opinions from previos administrations as well as the youtube yakity yak. He has clearly confirmed; SBRs are clearly defined and braced short barreled firearms are illegal according to the NFA, like it or not.
What happened to Andrew? I know it's been a while but I figured he was just taking some time off. It's been a few months now though and I never read anything about if he was still with ARFCOM or if he left.

For everyone bitching about the courts ruling on Pistol Braces. The courts got rid of Bidens BAN on pistol braces. BAN. So yes, you are allowed to own a pistol brace…..that doesnt change the definition of an SBR under the NFA. Do i agree with it, no, i dont, but stop saying that the courts struck down the rule allowing you to shoulder a braced pistol. The courts just said that braces couldnt be banned outright. Its still considered an SBR under the NFA. Washington Gun Law has an excellent video covering this topic.

It just sounds like more of the same and I understand the law but like… could we get a little clarity on "designed to be shouldered"?? From my understanding and court rulings and all a brace that is as is does not fit that description. Maybe a vfg could qualify that? But I don't appreciate nebulous answers. It feels like one step forward and one step back.

My comment, is from the beginning of this Video the NEW ATF Director stated something important – If you have a RIFLE with an over all length of thus and such and a barrel less than such and such then you have a SHORT BARRELED RIFLE.. He did NOT say if you have a PISTOL, or a barrel shorter than 16 inches on a PISTOL that you then have a Short Barreled Rifle. Had he stated that if YOU have a PISTOL and a shorter barrel than 16 inches and a Brace then you have a Short Barreled RIFLE, then that would be significant, but he did not state that, at least not in the opening minute or so of this Video.
Just SBR your lowers, it ain’t that big of a deal. How many of you guys are crossing state lines with your guns enough for it to become an administrative burden? Almost every one of us has a can which already puts us in a direct relationship with the ATF anyway so don’t bother with “muh registry”.
At this point there are just too many braces out there for them to really start arresting all of us. Its becoming the same with FRTs and you bet your ass I bought a One Horse Express last night, not because I can't be bothered to install and tune an FRT, but because its THE FIRST and there will only ever be one of those. Its a piece of history and now I own one.
PS if you get jammed up because of a brace, play this clip in court. When the GD ATF director HIMSELF owns these things, they don't have a leg to stand on.

The NFA is the ACT that enacts the ATF. The main problem is that the NFA is in all ways INFRINGMENT, regulation of any kind with respect to an individual's right to keep and bare arms infringes on that right. I'd consider regulation of firearm manufactures valid regarding making arms that are defective, dangerous in the wrong way or in some way violate another manufacturer's rights or patents. This would justify a normal sales tax, but, any tax against an individual right is an infringement. Infringement means that should I in any way modify something I own, that is my right to have and use and can in any way be charged, arrested, fined or imprisoned, then there is NO 2A. THE GOVERNMENT SHALL NOT INFRINGE, means that they, the government has no say, input, law, rule, regulation that can be used to in any way convert my right into a privilege. When the NFA and the ATF are gone we can get back to arresting criminals for crimes. Here they layer on hate crimes and crimes done with guns, take murder; there is no difference between murder with a gun vs. with a knife or with the hands. If you find that there is a murder the method is irrelevant, murder should get the death penalty or life in prison with no parole. Get rid of the NFA and the ATF, simplify police work as the work of keeping the peace, solving crimes and bringing criminals to justice.
