NRA-ILA | NRA Files Amicus Brief in Case Challenging Maryland’s Refusal to Recognize Out-of-State Carry Permits

The National Rifle Association joined the Second Amendment Foundation, Maryland Shall Issue, California Rifle & Pistol Association, Minnesota Gun Owners Caucus, Second Amendment Law Center, Citizens Committee for the Right to Keep and Bear Arms, and Cato Institute in filing an amicus brief urging the Maryland Supreme Court to grant review in Duvall v. State of Maryland, a case challenging Maryland’s refusal to recognize valid carry permits issued by other jurisdictions.

Darius Duvall was arrested and sentenced to three years’ incarceration for carrying a concealed handgun in Maryland while holding a valid District of Columbia carry permit. He has petitioned the Maryland Supreme Court to review his case, arguing that Maryland’s prohibition on carrying by a nonresident traveler who holds a valid carry permit from another jurisdiction violates the Second Amendment.

Our brief, filed in support of his petition, argues that Maryland’s refusal to recognize out-of-state carry permits is inconsistent with our Nation’s historical tradition of firearm regulation and thus violates the Second Amendment. Specifically, the brief presents extensive historical evidence showing that, contrary to Maryland’s law, Americans traditionally enjoyed especially strong legal protections when carrying firearms while traveling outside of their state of residence.
