Judge wrote that plaintiffs focused all the rule being unreasonable. Reading more carefully he seems to be suggesting challenging the underlying statute. Seems to me that reducing the NFAs scope could be best outcome we can hope for. As such I’ll say braced pistols ARE SBRs, thus NFA restriction is unconstitutional under Heller – even before applying Bruen tests.

If we are going to seriously consider the topic of "common use" then we need to start with the governments own numbers. How many rifles does the military, government agencies, and police have that are shorter than 16 inches. I'd say that very quickly proves common use.
This was very informative for me. I was thinking about buying an AR pistol so I could have another fire arm besides a pistol that wouldn’t break the bank. Now idk if I want to if the ATF is going to go forward with the pistol brace rule.

I already have class iii items in a revocable trust and registered personally…so it’s just free tax stamps for me 🎉 💥 who cares they will not be going door to door and then this rule will be annulled due to the lawsuits. Result: no rule in place and free tax stamps! Now I can put the braces to the side on other guns and put nice stocks on these rifles as “sbrs” and be grandfathered in to the upcoming commie rules as the good people of this country allow the commies and foreigners to take over. Good job USA…straight down the tubes
